Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of the ProperSend platform operated by ProperSend. It is incorporated into, and forms part of, our Terms of Service. By using the Service you agree to this AUP.

1. Bring Your Own Server (BYOS) responsibility

ProperSend is software only. We provide the campaign, automation, and analytics interface; you connect and control your own sending infrastructure (for example Amazon SES, SendGrid, Mailgun, or any SMTP relay). You are solely responsible for the email you send, the lists you use, your sender reputation, and your compliance with all applicable laws and with the terms of the sending and verification providers you connect.

2. Permitted use

You may use the Service to send email only to recipients who have given you verifiable, explicit permission (opt-in) to contact them, and only for lawful purposes consistent with this AUP and your providers' policies.

3. Consent and list requirements

  • All recipients must be 100% opt-in. Purchased, rented, scraped, or otherwise harvested lists are prohibited.
  • You must honor unsubscribe and opt-out requests promptly and keep suppression lists current.
  • You must accurately identify yourself as the sender and include a valid physical postal address and a working unsubscribe mechanism where required by law (e.g., CAN-SPAM, GDPR, CASL).

4. Prohibited content

You may not use the Service to create, send, or store content that:

  • Is illegal, fraudulent, deceptive, defamatory, harassing, or threatening.
  • Infringes intellectual property or violates the privacy or rights of any third party.
  • Contains malware, viruses, phishing, or links to malicious or deceptive destinations.
  • Promotes content commonly restricted by mailbox and delivery providers, such as illegal substances, certain financial or "get rich quick" schemes, or sexually explicit material, except where expressly lawful and permitted by your connected providers.

5. Prohibited activities

  • Sending unsolicited bulk email (spam) or any unauthorized advertising.
  • Falsifying headers, sender identity, or routing information.
  • Circumventing any provider's sending limits, suppression, or compliance controls.
  • Attempting to gain unauthorized access to the Service, other accounts, or any connected system, or otherwise probing, scanning, or testing the vulnerability of our systems without authorization.
  • Interfering with or disrupting the integrity or performance of the Service.

6. Third-party provider compliance

Because you bring your own sending and verification services, you must also comply with the acceptable use, anti-spam, and content policies of each provider you connect. A violation of a connected provider's terms is also a violation of this AUP.

7. Enforcement

We may investigate suspected violations and, where appropriate, remove content, throttle activity, or suspend or terminate accounts. Serious or repeated violations may result in immediate termination without refund, as described in our Terms of Service. We may also be required to cooperate with lawful requests from authorities.

8. Reporting abuse

If you believe email sent through ProperSend violates this AUP, report it to abusepropersend.com. Please include message headers and any relevant details so we can investigate.

9. Changes

We may update this AUP from time to time. Material changes will be reflected by the "Last Updated" date above. Continued use of the Service after changes take effect constitutes acceptance.
